The Court of Cassation of the Republic of Armenia annulled the decision of the Court of Appeal to abolish detention of RA second President Robert Kocharyan and sent the case to the same court for a new investigation.
Armenpress reports that the Court of Cassation, having examined the complaints of the RA Prosecutor General and Robert Kocharyan’s lawyers against the decision of the RA Court of Appeals, made a decision to satisfy the Prosecutor General’s request partially and to reject Robert Kocharyan’s cassation appeal.
The decision comes into legal force from the date of its publication at the court session and is not subject to appeal.
The RA Prosecutor General filed a cassation complaint against the decision of the Court of Appeal to reverse the decision of the First Instance Court on the application of detention as a means of extirpation for Robert Kocharyan, but the Court of Cassation decided to satisfy the appeal of the Prosecutor General, partially rejecting the decision of the Court of Appeal and sending the case to a new examination :
