YEREVAN, JUNE 15, In the RA Court of Cassation, the decision on the appeal of his lawyer was published at the court hearing on the case of former NKR Defense Minister Samvel Babayan. Armenpress reports that the Court of Cassation dismissed the decision of the Court of Appeal on leaving the verdict of the court of general jurisdiction over the case of Samvel Babayan and others, sending the case to a new examination.
The cassation also decided to change Babayan’s detention and release him, taking into account the guarantees of the deputies. Sanasar Gabrielyan, who passed the case, was also released from custody.
Twelve members of the Tsarukyan faction have personally given their assurance on Sanasar Gabrielyan’s arrest as a preventive measure for Samvel Babayan and three years in jail. MPs Naira Zohrabyan, Aram Sargsyan, Vahan Karapetyan, Hrant Madatyan, Sergei Bagratyan, Arayik Aghababyan, Ararat Zurabyan, Vardan Bostanjyan, Vahe Enfiajyan, Tigran Stepanyan, Iveta Tonoyan and Arthur Manukyan have been given a guarantee.
Earlier, two MPs from the “Exit” faction Hovik Aghazaryan and Sasun Mikaelyan had their personal guarantee.
Samvel Babayan was found guilty under Part 2 of Article 38-235 of the RA Criminal Code and Article 190 § 1 and was sentenced to 6 years in prison. He was charged with involvement by a group of individuals, with preliminary consent to participate in the illegal acquisition, transportation and storage of the Igla’s portable anti-aircraft missile complex. He also obtained the proceeds of crime as a result of the conversion. Avetis Kalashian, an attorney at the Babayan case, applied to the Court of Cassation on April 26. The lawyer complains about the verdict of Kentron and Nork-Marash District Court of Yerevan on Samvel Babayan’s six-year imprisonment, which the RA Court of Appeals left unchanged. Sanasar Gabrielyan was charged with the fact that he had illegally acquired, transported and maintained a group of people with a “Igla” type of portable anti-aircraft missile complex. He was sentenced to three years in prison.
